General information

This website (berapatterns.com) (the Site) is run and maintained by BERA PATTERNS S.L.L. ("BERA Patterns", "we", "us"), a Sociedad Limitada Laboral registered in Spain, with NIF B88906474 and whose registered office is at Calle de la Infanta Mercedes 16, 4º izquierda, 28020 Madrid, Spain. It is registered with the Commercial Registry of Madrid, Section 8, Sheet M-884576, Entry 1. Our email address is info@berapatterns.com.

BERA Patterns is an online sewing business. We sell downloadable digital sewing patterns (available in A0, A4 and US Letter formats), online sewing courses (video tutorials and accompanying digital materials), and we organise in-person sewing workshops.

These Terms of Service (Terms) cover the terms on which you may use the Site, place an order, and access our products. Please read them carefully before you submit an order. By using the Site or placing an order, you accept and agree to be bound by these Terms and by our Privacy Policy and our Refund Policy. If you do not accept them, please do not use the Site.

Your right to use the Site

You have permission for temporary, non-exclusive use of the Site to browse and purchase our products. We reserve the right to withdraw or change the content of the Site and these Terms at any time.

You are not allowed to copy, modify, duplicate, create derivative works from, mirror, republish, or distribute all or any part of the Site itself, beyond what is needed for your own personal browsing and shopping.

You are responsible for configuring your own device and software to access the Site and any files you download from it, including checking that your printer or copy shop can handle A0, A4, or US Letter files as applicable.

You must keep any account login details confidential. If we believe your account security has been compromised, we may disable it.

Orders and pricing

A contract between you and us is only formed once we accept your order. For digital patterns and courses, this happens automatically when your payment is confirmed. For workshops, it happens when we send you a booking confirmation.

All prices shown on the Site include applicable taxes. As all our products are digital or in-person services, no shipping charges apply. If you buy from outside the European Union, your own country may apply its own taxes, duties or charges, which are outside our control and are payable by you.

We take reasonable care to make sure prices on the Site are accurate, but if we discover a pricing error before accepting your order, we will contact you to ask whether you would like to proceed at the correct price or cancel and receive a full refund.

Digital patterns and online courses

When you buy a digital pattern or a course, we grant you a personal, non-transferable licence to download and print the pattern, or access the course content, for your own personal use, including making finished garments to sell, unless the specific product page says otherwise.

You may not resell, redistribute, share, or upload the pattern files, videos, or course materials themselves to any other person, marketplace, or platform, or claim the design or course content as your own.

Because digital patterns and courses are delivered electronically, once you download a pattern file or access course content, our normal cooling-off period no longer applies; see our Refund Policy for the full detail and the consent you give at checkout confirming this.

Workshop bookings

Workshops are booked for a specific date, time, and location shown on the Site. Once a booking is confirmed, cancellations for change of mind are handled under our Refund Policy. If we need to cancel or reschedule a workshop, we will offer you a full refund or a place on an alternative date.

Workshops are open to participants aged 7 and over unless a specific workshop states otherwise. Participants under 18 must have the consent of a parent or guardian to attend.

We may take photographs or videos during workshops for use in our marketing materials and on social media. If you would prefer not to be included, please let us know before the workshop begins.

Customer reviews and content

If the Site allows you to leave reviews or other content, it must be honest, based on a genuine purchase or experience, and must not be defamatory, obscene, infringe anyone else’s rights, or otherwise breach applicable law. By submitting a review, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display it on the Site and in our marketing materials. We may remove any review that breaches these Terms.

Your data and confidentiality

Personal information you give us through the Site is handled in line with our Privacy Policy. We do not store your full card details, and we do not share your personal information with third parties except where necessary to fulfil your order (payment processing, course platform access) or where required by law.

Changes to these Terms

We may update these Terms from time to time. Please check back periodically: continued use of the Site after a change means you accept the updated Terms. The version in force at the time you place an order applies to that order.

Intellectual property rights

We are the owner or licensee of all intellectual property in the Site, our pattern designs, course content, videos, written instructions, and branding. They are protected by copyright and other applicable law. You may only use them as set out in these Terms. Using them outside these Terms ends your right to use the Site and may require you to destroy any copies you have made.

Our responsibility to you

We provide our patterns, courses, and workshops with reasonable skill and care, but sewing results depend on individual skill and materials, which we do not control.

We do not limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Spanish or EU law.

Workshops involve the use of sewing machines, needles, scissors, and other sewing tools. By attending, you acknowledge the ordinary risks associated with using such equipment and agree to follow any safety instructions given by our workshop staff.

Subject to that, we are not liable to you for indirect or consequential loss, including loss of profit or loss of savings, arising from your use of our products.

Although we try to keep the Site available at all times, we do not guarantee uninterrupted access and are not responsible for losses arising from technical interruptions outside our control.

Events outside our control

We are not liable for any delay or failure to perform our obligations if that delay or failure results from events outside our reasonable control, such as illness, extreme weather, or venue unavailability. If such an event affects a workshop, we will offer you a refund or a place on an alternative date.

Links to other sites

Links from our Site to other websites are for information only. We do not accept responsibility for the content of those sites or any loss you may suffer from relying on them.

Misuse of the Site

You must not attempt to gain unauthorised access to our servers, introduce viruses or other harmful material, or otherwise attack the Site. Doing so ends your right to use the Site immediately and may be reported to the relevant authorities.

General provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

We may transfer our rights and obligations under these Terms to another organisation, for example if we sell our business or its assets; this will not affect your rights under these Terms.

The Site and these Terms are available in several languages for your convenience. In the event of any conflict between different language versions, the Spanish version shall prevail.

Governing law and jurisdiction

These Terms are governed by Spanish law. If you are an EU consumer, you may also rely on the mandatory consumer protection rules of your own country of residence. Disputes may be brought before the competent Spanish courts or before those that are legally available to you as a consumer.
